1. INTRODUCTION AND DEFINITIONS
1.1 MoaiFit is a trademark of CANARIAN INSIGHT SL (trading as BookingArt), CIF B13898804, with registered office at Avenida de los Pueblos 20, LC 69, Costa Adeje, Santa Cruz de Tenerife, Canary Islands, Spain (hereinafter "Company").
1.2 MoaiFit (hereinafter "Platform") is a digital service connecting users ("Clients") with fitness professionals ("Coaches") and sports facilities ("Gyms") in the Canary Islands.
1.3 Access and use of the Platform implies full acceptance of these Terms and Conditions.
2. REGISTRATION AND ACCOUNT
2.1 A registered account with truthful data is required. Registration is possible via email/password or social login (Google, Apple).
2.2 Users are responsible for the security of their credentials and all activities performed through their account.
2.3 CANARIAN INSIGHT SL reserves the right to suspend or delete accounts that violate these Terms.
3. PAYMENT SYSTEM AND WALLET
3.1 The Platform uses a digital Wallet system. Payments are processed via Stripe or Apple In-App Purchase.
3.2 A variable commission is charged on Coach fees (Free: 20%, Standard: 15%, Premium: 10%).
3.3 Wallet funds are not refundable in cash, except as provided by applicable law.
4. BOOKINGS AND CANCELLATIONS
4.1 Bookings are subject to Coach confirmation.
4.2 Free cancellation with at least 24 hours notice. In case of no-show without cancellation, the Coach may request payment, subject to administrator approval.
4.3 In case of mutual dispute, the administrator intervenes to resolve the situation.
5. SESSION PACKAGES
5.1 Coaches may offer session packages at advantageous prices, with an expiry date and defined number of sessions.
6. DISCOUNT CODES
6.1 Coaches and Gyms may generate discount codes for their Clients, subject to specific conditions. Codes are not cumulative and not convertible to cash.
7. LIMITATION OF LIABILITY
7.1 CANARIAN INSIGHT SL acts as an intermediary. It is not responsible for service quality or injuries from training sessions.
7.2 Coaches are independent professionals responsible for their own activity, qualifications, and professional insurance.
8. INTELLECTUAL PROPERTY
8.1 All Platform content is the property of CANARIAN INSIGHT SL or its respective owners.
9. MODIFICATIONS
9.1 CANARIAN INSIGHT SL reserves the right to modify these Terms at any time, communicating changes via in-app notification or email.
10. GOVERNING LAW
10.1 These Terms are governed by Spanish law. Any disputes shall be subject to the jurisdiction of Santa Cruz de Tenerife.
